Welcome to Video Live!

Video Live takes your privacy seriously, and we are committed to maintaining the privacy of the personal information that you provide to us. This Privacy Policy explains how Video Live processes your personal information in connection with providing our website and communication service that we make available through applications that we offer on various mobile operating systems and on Windows and Mac personal computer operating systems (collectively, the “Services”). By using our Services, you acknowledge that the terms and conditions in this Privacy Policy will apply to you, as well as to any information that you provide us. Please take the time to read through this Privacy Policy to get acquainted with our practices.

We sometimes use capitalized terms in this Privacy Policy; if they’re not defined here, they’re defined in our Terms of Service.

1. Information We Collect

We collect personal information to provide, support, improve, and market the Services. Some of the ways that we may collect personal information include information that you provide us directly; information that we automatically collect when you use our Services; and information that we collect from others.

a. Types of Personal Information We Collect

i. Information that you provide us directly

What is it?

• Information you give us when you register an account. You will need to “Sign in with Apple” to create a Video Live account. We use the information provided when you “Sign in with Apple” as your account identifier. You also have the option of providing your first and last name, and a username in your profile.
• Information that you post on your Video Live user profile (this might include profile pictures and other information).
• Content that you share with the Services, including with other Video Live users. This includes, but is not limited to, messages, comments, photos, videos, and/or audio content you livestream. We do not typically store your livestreamed content on our servers, but we may store screenshots and/or audio snippets of your livestreamed content.
• If our Services have your permission, we collect contact information from your mobile address book to connect you to your friends on Video Live or allow you to invite your friends to Video Live.
• Information you give us during any support and feedback communications via email, postal mail or chat.

Other things you should know:

• We may remove, at our sole discretion, any information that you provide when you register for or use the Service (such as usernames, profile pictures, names, etc.), if we believe it is inappropriate or violates any of the policies posted on our Policies page at https://videoliveapp.com/policies, including, but not limited to, our Terms of Service.

ii. Information that we automatically collect

What is it?

• Video Live automatically collects certain information when you use our Services, like device or browser identifiers (e.g., cookies and similar identifiers), IP address, user settings, phone model, connection type (e.g., cellular or WiFi), mobile carrier, push notification token, the operating system of your device, and other details. We may also automatically collect information regarding your use of our Services, such as pages that you visit before, during and after using our Services, information about the links you click, the types of content you interact with, your transactions on the Services, the frequency and duration of your activities, and other information about how you use our Services. We may also include web beacons in e-mails to understand whether messages have been opened, acted on, or forwarded.
• When you use our livestreaming features, we and other Video Live users may collect personal information that you make available. This includes, but is not limited to, your livestreamed content, your username, your country (based on your carrier country code), and profile. We may also store a list of your livestream followers and a list of people you follow. We may also monitor your livestreams in our sole discretion.

b. Payment information

What is it?

• If you choose to make purchases through the Services (e.g., for our premium service), we process your payments through a third-party payment processor/application, such as Stripe, the Apple App Store or Google Play App Store.

c. Location Information

What is it?

• When you use our Services, we may collect and store information about your location by converting your IP address into a rough geo-location or by accessing your mobile device’s GPS coordinates or precise location if you enable location services on your device.

iii. Information That We Collect from Others

What is it?

• We may collect information about you from other Video Live users and third-party sources. For example, we may collect information that other people provide about you when they upload content about you to our Services.

2. How We Use Your Information

We use your information for a variety of business purposes, including to provide our Services, for administrative purposes, to market our Services, and other purposes, as described below.

a. To Provide the Services

• Enabling you to access and use the Service, including to manage user information and accounts;
• Contacting you to answer requests for customer support or technical support;
• Communicating with you about your account, activities on our Services, and policy changes;
• Processing your financial information and other payment methods for in-app transactions or Services purchased; and
• Allowing you to invite friends or colleagues to use the Services.

b. Administrative Purposes

• Pursuing our legitimate interests such as direct marketing, content moderation, research and development (including marketing research), network and information security, and fraud prevention;
• Detecting security incidents, protecting against malicious, deceptive, fraudulent or illegal activity, and prosecuting those responsible for that activity;
• Improving, upgrading or enhancing our Services;
• Measuring interest and engagement in our Services;
• Developing new products and Services;
• Ensuring internal quality control and safety;
• Authenticating and verifying individual identities, including requests to exercise your rights under this Privacy Policy;
• Debugging to identify and repair errors with our Services;
• Auditing relating to interactions, transactions and other compliance activities;
• Enforcing our agreements and policies, including our Terms of Service; and
• Complying with our legal obligations.

c. Marketing our Services

We may use personal information to tailor and provide you with content and advertisements. We may provide you with these materials as permitted by applicable law.

d. Consent

We may use personal information for other purposes that are clearly disclosed to you at the time you provide personal information or with your consent.

e. De-Identified and/or Aggregated Information

We may use personal information and other information about you to create de-identified and/or aggregated information, such as de-identified demographic information, de-identified location information, information about the device from which you access our Services, or other analyses we create. You acknowledge and agree that we own all such aggregated and/or de-identified information, and have the unrestricted right to use such information and to disclose or distribute such information to third parties as we see fit, throughout the world, in any media or form.

3. Sharing Your Information.

a. Information we share

We disclose your information to third parties for a variety of business purposes, including to provide our Services, to protect us or others, or in the event of a major business transaction such as a merger, sale, or asset transfer, as described below.

• We may share your personal information with our third-party service providers who use that information to help us provide our Services. This includes service providers that provide us with IT support, hosting, payment processing, customer service, and related services.
• Our Services allow you to share information and/or interact with others. For example, other users of the Services may view your profile information that is generally available to all users of the Services. In addition, we may send push notifications to your followers letting them know when you go live and others may view Your Content that you make available. Photos, videos, and posts shared via our Stories feature will be shared with your followers on Video Live for up to 24 hours.
• We may share your personal information with our company affiliates.
• We may access, preserve, and disclose any information we store associated with you to external parties if we, in good faith, believe doing so is required or appropriate to: comply with law enforcement or national security requests and legal process, such as a court order or subpoena; protect your, our, or others’ rights, property, or safety; enforce our policies or contracts; collect amounts owed to us; or assist with an investigation or prosecution of suspected or actual illegal activity.
• We may transfer your information in the event that Video Live is involved in a merger, acquisition, divestiture, consolidation, reorganization, asset sale, bankruptcy, or similar event.

4. Opting out of Receiving Communications

You may have the right to opt out of certain uses of your personal information.

a. Email communications

IIf you receive an unwanted email from us, you can use the unsubscribe link found at the bottom of the email to opt-out of receiving future emails. We will process your request within a reasonable time after receipt. Note that you will continue to receive transaction-related emails regarding products or services you have requested. We may also send you certain non-promotional communications regarding Video Live and our Services and you will not be able to opt out of those communications (e.g., communications regarding updates to our Terms of Service or this Privacy Policy).

b. Mobile devices

Video Live may occasionally send you push notifications through our mobile applications. You may at any time opt-out from receiving these types of communications by changing the settings on your mobile device. We may also collect precise location-based information if you use our App. You may opt-out of this collection by changing the settings on your mobile device.

c. Do Not Track

Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers and devices. DNT is a way for users to inform websites and services that they do not want certain information about their webpage visits collected over time and across websites or online services. Please note that we do not respond to or honor DNT signals or similar mechanisms transmitted by web browsers.

5. Your Choices and Privacy Rights

a. Your Choices

You can download your information, edit your information, or delete your account at any time in accordance with the standard functionality of the Service.

• You can request a download of your account information. To request a download, navigate to the “Request Account Info” button inside the Settings section of the App.
• You may edit your account information via the App.
• You may delete your entire account, by selecting the “Delete Video Live account” option in the settings of the App. Please be aware that, for technical reasons, when you delete your account, related information may persist for a limited period of time in our backup copies. Even if you delete your entire account, we may retain limited information for our business and compliance purposes such as fraud detection and enforcement of our Terms of Service.

b. Your Privacy Rights

In accordance with applicable law, you may have the right to:

• Access Personal Information about you, including: (i) confirming whether we are processing your personal information; (ii) obtaining access to or a copy of your personal information; and (iii) receiving an electronic copy of personal information that you have provided to us, or asking us to send that information to another company (the “right of data portability”);
• Request Correction of your personal information where it is inaccurate or incomplete. In some cases, we may provide self-service tools that enable you to update your personal information;
• Request Deletion of your personal information;
• Request Restriction of or Object to our processing of your personal information; and
• Withdraw your Consent to our processing of your personal information.

6. Supplemental California Privacy Notice

If you are a resident of Nevada, you have the right to opt-out of the sale of certain personal information to third parties who intend to license or sell that personal information. Please note that we do not currently sell your personal information as sales are defined in Nevada Revised Statutes Chapter 603A. If you have any questions, please contact us as set forth below.

The categories of sources from which we collect personal information and our business and commercial purposes for using personal information are set forth above.

Additional Privacy Rights for California Residents

• “Sales” of Personal Information under the CCPA. For purposes of the CCPA, Video Live does not “sell” personal information, nor do we have actual knowledge of any “sale” of personal information of minors under 16 years of age.
• Non-Discrimination. California residents have the right not to receive discriminatory treatment by us for the exercise of their rights conferred by the CCPA.
• Authorized Agent. Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. To designate an authorized agent, please contact us as set forth below

• Verification. When you make a request, we will ask you to provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, which may include confirming the email address associated with any personal information we have about you.

  If you are a California resident and would like to exercise any of your rights under the CCPA, please contact us as set forth below. We will process such requests in accordance with applicable laws.

• Accessibility. If you are an individual with a disability that needs to access this Privacy Policy in a different format, please contact us as set forth below for assistance.

7. Supplemental Nevada Privacy Notice

This Supplemental California Privacy Policy only applies to our processing of personal information that is subject to the California Consumer Privacy Act of 2018 (“CCPA”). The CCPA provides California residents with the right to know what categories of personal information Video Live has collected about them and whether Video Live disclosed that personal information for a business purpose (e.g., to a service provider) in the preceding twelve months. California residents can find this information below:

8. Data Retention

Video Live retains the personal information we receive as described in this Privacy Policy for as long as you use our Services or as necessary to fulfill the purpose(s) for which it was collected, provide our Services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.

9. Security

We take steps to ensure that your information is treated securely and in accordance with this Privacy Policy. Unfortunately, no system is 100% secure, and we cannot ensure or warrant the security of any information you provide to us. To the fullest extent permitted by applicable law, we do not accept liability for unauthorized disclosure.

By using the Service or providing personal information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Service. If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice within the Service.

10. International Transfer

All information processed by us may be transferred, processed, and stored anywhere in the world, including, but not limited to, the United States or other countries, which may have data protection laws that are different from the laws where you live. We endeavor to safeguard your information consistent with the requirements of applicable laws.

11. Children’s privacy

The Services are not directed to children under 17 years of age, and Video Live does not knowingly collect personal information from children under 17 years of age. If you learn that your child has provided us with personal information without your consent, you may delete your child’s entire account, by selecting the “Delete Video Live account” option in your child’s Video Live account settings or alert us at privacy@videoliveapp.com. If we learn that we have collected any personal information from children under 17 in violation of applicable law we will promptly take steps to delete such information and terminate the child’s account.

12. Third Party Websites/Applications

The Services may contain links to other websites/applications and other websites/applications may reference or link to our Services. These third-party services are not controlled by us. We encourage our users to read the privacy policies of each website and application with which they interact. We do not endorse, screen or approve, and are not responsible for, the privacy practices or content of such other websites or applications. Providing personal information to third-party websites or applications is at your own risk.

13. Supervisory Authority

If you are located in the European Economic Area, Switzerland, or the United Kingdom, you have the right to lodge a complaint with a supervisory authority if you believe our processing of your personal information violates applicable law.

14. Changes to Our Privacy Policy

We may modify our Privacy Policy from time to time. If there are any material changes to this Privacy Policy, we will notify you as required by applicable law. You should check this Privacy Policy on a regular basis, since revised versions will be binding on you. Any such modifications will be effective when we post the updated Privacy Policy. You understand and agree that your continued access to our Service after any posted modification to the Privacy Policy indicates your acceptance of those modifications.
